Have your say: Sellicks Hill Old Closed Roads – proposed Community Land revocation

The District Council of Yankalilla is inviting community feedback on a proposal to revoke the Community Land classification of four old closed roads located within a farming property at Sellicks Hill.

Council has received a request from Ashley Park Pastoral to purchase the former road corridors (Closed Roads), which run through their land. Before any sale could occur, Council must first consider whether to revoke the Community Land classification through a legislated process under the Local Government Act 1999.

Community members are encouraged to review the information on Your Say Yankalilla and share their views before Council makes any decision.

What is being proposed?

Council has received a proposal from Ashley Park Pastoral, a farming property at Sellicks Hill, to purchase four old closed roads that run through their land.

These former road reserves are known as Closed Roads. They were never used as public roads and are common in rural areas where historic surveyed road corridors remain on property titles. Over time, many of these corridors have become part of surrounding farmland and are not accessible to the public because they run through private property.

The land involved in this proposal is legally described as Allotments C, D, E and F in Road Plan 1635.

When the Local Government Act 1999 came into effect, land like this was automatically classified as Community Land. Council has assessed these closed roads and determined they are surplus to Council’s needs.

Council is now considering whether to revoke the Community Land classification so the land could potentially be sold to the adjoining property owner.

Why are we consulting?

Community Land cannot be sold unless its classification is formally revoked through a process set out in the Local Government Act 1999.

This process requires Council to:

  • prepare a Community Land Revocation Report
  • consult with the community
  • consider all submissions received before making a decision.

If Council decides to proceed following consultation, the proposal must also be approved by the Minister for Local Government before the land can be sold.

Importantly, declaring land surplus does not mean it will automatically be sold. The revocation process ensures the proposal is transparent and that community views are considered before any decisions are made.

Have your say

Council is inviting the community to review the Revocation Report and provide feedback on the proposal.

This is your opportunity to tell us:

  • whether you support or oppose the proposed revocation
  • what factors Council should consider when making its decision.

Your feedback will help Council understand local perspectives and ensure any decision considers the long-term interests of the community.
