Fire Permits - Outside Fire Season

The Environment Protection (Air Quality) Policy 2016 (“the 2016 Policy”) replaces / consolidates several Environment Protection Policies.

The new policy prohibits burning-off within Townships, without written permission from Council, and restricts the burning of wood or other plant material for the purposes of domestic heating within a Township (ie in a brazier, fire pit or chimenea).

WHEN IS THE FIRE DANGER SEASON?

The Fire Danger Season is determined by the South Australian CFS and generally runs from 1 December to the 30 April, Nevertheless, it’s important to note that these dates can be modified in response to changes in seasonal conditions.

WHAT BURNING CAN YOU DO OUTSIDE OF THE FIRE SEASON?

Inside a Township
  • Lighting or maintaining fires for the purpose of preparing food or beverages using charcoal, dry wood or other dry plant material;
  • Burning charcoal (but not wood or other plant material) in braziers for domestic heating including in chimeneas and fire pits.
Outside a Township
  • Lighting or maintaining fires for the purpose of preparing food or beverages using charcoal, dry wood or other dry plant material;
  • Lighting or maintaining a fire using charcoal, dry wood or other dry plant material for a camp-fire or barbecue in the course of camping, scouting or a similar outdoor recreational activity; and
  • Burning agriculture or forestry waste, burning off vegetation for fire prevention or control, or burning vegetation for any other purpose, outside a fire danger season provided that:
    • the burning takes place only on land owned or occupied by the person or on land with the consent or authority of the owner or occupier; and
    • the person complies with any mandatory measures and has regard to any recommended measures contained in the codes of practice prepared by the CFS.

WHAT ACTIVITIES ARE PROHIBITED WITHIN A TOWNSHIP?

  • Burning agriculture or forestry waste;
  • Burning off vegetation for fire prevention or control;
  • Burning vegetation for any other purpose; or
  • Any other burning off activity.

The above activities are prohibited without a permit from the District Council of Yankalilla.

WHAT IS THE ALTERNATIVE TO BURNING IN THE TOWNSHIP?

Council encourages residents to utilise the Yankalilla Waste and Recycling Depot for the disposal of “green waste” so it can be recycled.  Smoke from burning fires can be an irritant, nuisance and cause frustration to other residents and is a major cause of complaints to Council and neighbourhood disputes.

Depending on the matter being recycled, and volume, costs may be incurred when visiting the Yankalilla Waste and Recycling Depot.  See below for guidelines.

EXPIATIONS

Non-compliance with the legislation may result in an Expiation being issued.  Burning without a permit, when one is required has been classified by the legislation as a Category B offence.  There is an expiation fee associated with this type of offence.

IN SUMMARY

Unless a permit is provided, burn offs within the townships of the District Council of Yankalilla are PROHIBITED ALL YEAR ROUND.

Council reserves the right to authorise the lighting of fires within township zones for exceptional circumstances and for it’s own operational requirements.
